Welcome to BuildMyAuthor (“Company,” “Firm,” “we,” “us,” or “our”). BuildMyAuthor is a specialized author growth consultancy and digital marketing agency providing strategic positioning, campaign execution, and publishing advisory services to authors worldwide.

These Terms of Service (“Terms”) govern all access to and use of our website, service frameworks, consulting blueprints, and executed Statements of Work (SOW). BuildMyAuthor operates as a registered commercial entity under the legal ownership of Bittu Kumar, operating professionally as Jay (trading as BuildMyAuthor), headquartered in Ranchi, Jharkhand, India. All communications, operational directives, and client engagements conducted by company executives, strategic advisors, or brand representatives remain fully bound by these legal and contractual terms.

By accessing our platform, making a payment, onboarding into our strategy frameworks, or executing an agreement with BuildMyAuthor, you (“Client,” “Author,” or “you”) agree to be bound by these Terms.

1. Nature of Services & Operational Model

BuildMyAuthor operates as a digital-first consultancy and marketing agency. Services are delivered through structured strategy sessions, custom growth blueprints, positioning audits, and marketing execution deployed by our internal team and network of publishing specialists.

Scope of Engagement: Specific deliverables, timelines, and execution parameters are defined in the relevant service selection or Statement of Work (SOW) executed between the Client and BuildMyAuthor.

Independent Contractor Status: BuildMyAuthor acts solely as an independent service provider. Nothing in these Terms creates a partnership, joint venture, employer-employee, or agency relationship between the Client and the Firm.

2. Strategic Disclaimer & Limitation of Liability

No Commercial or Sales Guarantees: All marketing plans, promotional campaign structures, metadata optimizations, and media strategies provided by BuildMyAuthor are advisory frameworks based on prevailing publishing industry standards and historical market data. Author visibility, retail algorithm performance, and reader conversion depend on external factors beyond our control, including third-party platform algorithms (e.g., Amazon, IngramSpark, Meta, Google), market demand, and reader preferences. BuildMyAuthor explicitly disclaims—and the Client acknowledges—that we do not guarantee specific book sales volumes, bestseller rankings, royalty amounts, or guaranteed media coverage.

Liability Cap: To the maximum extent permitted under applicable laws of the Republic of India, the total aggregate liability of BuildMyAuthor, its proprietor, employees, and contractors for any claims, losses, damages, or causes of action arising out of or related to our services shall be strictly capped at the total fee amount actually paid by the Client to BuildMyAuthor for the specific service segment or Statement of Work in dispute.

Consequential Damages: In no event shall BuildMyAuthor be liable for any indirect, incidental, special, reliance, or consequential damages (including loss of profits, data, or business opportunity).

3. Payment, Refund & Cancellation Policy

As an agency that allocates dedicated creative assets, strategy hours, and operational resources immediately upon project confirmation, our cancellation and refund policies are structured as follows:

48-Hour Cancellation Window: Clients may request a service cancellation and partial refund strictly within 48 hours of the initial transaction timestamp. To initiate a cancellation, a formal written request must be submitted to info@buildmyauthor.com detailing the transaction reference and invoice number.

Non-Refundable Processing Fees: Third-party payment gateway charges, currency conversion levies, and administrative settlement fees are 100% non-refundable under all circumstances and will be deducted from any eligible refund.

Work-in-Progress Adjustments: If operational work has commenced within the 48-hour window—including resource reservation, manuscript review, creative brief onboarding, or design draft production—the refund amount will be reduced on a prorated basis to cover actual labor hours and resources utilized.

Absolute Exclusion After 48 Hours: Once 48 hours have elapsed from the payment timestamp, all fees paid become completely non-refundable, non-assignable, and fully earned by BuildMyAuthor. Chargebacks, payment disputes, or arbitrary transaction reversals initiated after this window will be contested based on these agreed Terms.

4. Intellectual Property & Deliverables Assignment

Client IP Rights: The Client retains complete, unencumbered ownership and copyright over all underlying manuscripts, outlines, characters, plot points, images, and personal brand assets provided to BuildMyAuthor.

Assignment of Work Product: Upon receipt of full and final payment for the designated services, BuildMyAuthor assigns to the Client all exclusive rights, title, and interest in custom deliverables created specifically for the Client (such as custom graphic layouts, advertising copy, and cover design assets).

Sub-Contractor Rights: BuildMyAuthor warrants that all independent contractors and specialists engaged by the Firm operate under binding intellectual property assignment agreements, ensuring a clean and complete chain-of-title transfer to the Client upon full account settlement.

Agency Portfolio Rights: Unless explicitly restricted in writing via a signed Non-Disclosure Agreement (NDA), BuildMyAuthor reserves the right to display completed visual work, high-level campaign metrics, and general case study outcomes for agency portfolio and promotional purposes.

5. Governing Law & Dispute Resolution

Jurisdiction: These Terms, their interpretation, and any legal disputes or claims arising out of or in connection with BuildMyAuthor’s services shall be governed exclusively by the laws of the Republic of India.

Exclusive Venue: The Client agrees that any legal suit, action, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the competent statutory courts located in Ranchi, Jharkhand, India.

Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
